STEPS OF THE JUDICIAL CITIZENSHIP PROCESS

Learn the steps to obtain your Italian citizenship via the judicial route. To learn about the process in another country, please get in touch.

STEP 1 – DISTRIBUTION OF THE CASE:

Upon receiving the documents at our Alpha Cidadania office in Italy, we proceed with the filing of the judicial action.

 

STEP 2 – CASE NUMBER:

After filing the judicial action, the Court will issue the case number (RG — Ruolo Generale) within an average period of 20 to 25 days.

 

STEP 3 – ONLINE TRACKING:

It is possible to track the progress of the case online. To do so, you must download the “Giustizia Civile” app on your mobile device.
 

On a smartphone:

To locate the case, the interested party must:

  1. Access the “UFFICI” section;

  2. Enter the name of the Competent Court;

  3. Select “TRIBUNALE ORDINARE”;

  4. Enter the case number and the protocol year in the “RUOLO GENERALE” field.

 

On a desktop:

To check the action, the interested party needs to:

  1. Access the portal “Portale dei Servizi Telematici del Ministero della Giustizia” – Link here;

  2. Choose the region (Regione);

  3. Select the name of the Competent Court (Uffici giudiziari);

  4. Mark the type of Registry (choose ‘contenzioso civile’);

  5. Select “Consulta”;

  6. Enter the case number and the protocol year in the “Ruolo generale” field.
     

Note that according to Italian Privacy Law, the names of the applicants and attorneys are only displayed by the initials of their surnames and first names, with the surname appearing before the first name.

STEP 4 – DESIGNATION OF THE JUDGE:

After the filing of the action and the numbering of the case, the next step is the selection of the judge. This process may take an average of 3 months and depends entirely on the Court.

STEP 5 – HEARING

Upon the designation of the judge, it is his responsibility to schedule the hearing date, which may be set within an average period of 6 months to one and a half years.

There is no possibility of intervention during this period, nor on the date determined by the judge.
 

It is important to note that the applicants do not need to attend the hearing, or any other moment of the process, as they will be represented by our lawyers.

STEP 6 – VERDICT

Judges do not announce a verdict during the hearing. After the hearing, the case files remain with the judge ("riserva" in Italian or "conclusos" in Portuguese) until the verdict is issued. This period may take an average of 30 to 60 days.

 

STEP 7 – APPEAL

After the verdict is published in the Official Gazette, the aggrieved party has 30 days, starting from the date of publication, to file an appeal. If no appeal is filed within this period, the verdict will be considered final.

With the verdict becoming final, there is no longer any possibility of contesting the decision, and the claimants will be considered Italian citizens from birth!

 

STEP 8 – CERTIFICATE OF FINAL JUDGMENT

After the verdict becomes final, an additional 30 days must be waited before requesting the Certificate of Final Judgment.

Only with this document is it possible to carry out the transcription (notation) of the verdict in the competent Comune (Civil Registry), that is, in the Comune (municipality) of the Italian ancestor.

STEP 9 – TRANSCRIPTION OF CIVIL ACTS IN THE ANCESTOR’S COMUNE – ITALIAN CIVIL REGISTRY

The transcription of the civil acts (birth and/or marriage) of the applicants in the competent Comune depends exclusively on that public authority.

According to Italian legislation, the Comune has a period of up to 180 days to complete this step.

At this moment, it is also possible to present documents related to any divorces. Once the respective certificates are obtained, our team will conclude the service.

STEP 10 – UPDATE THE AIRE – REGISTRATION OF ITALIANS LIVING ABROAD

To register in the AIRE (Consular Register), simply access the website of the relevant Italian Consulate corresponding to the interested party’s region of residence and follow the provided instructions. If the Consulate is the one in São Paulo, click here.

The Italian Consulate is responsible for taking care of Italians residing outside of Italy. Therefore, it is the appropriate agency to request the issuance of a passport or to handle any other need of an Italian citizen related to Italy.

Please note that it is mandatory to always keep the Italian citizen’s data updated (address, marriage registration, divorce, birth of children, etc.), under penalty of non-issuance or non-renewal of the Italian passport.

Competence of the Italian Consulates in Brazil:

  • Italian Consulate General in São Paulo: States of São Paulo, Mato Grosso do Sul, Mato Grosso, Rondônia, and Acre;

  • Italian Consulate General in Curitiba: States of Paraná and Santa Catarina;

  • Italian Consulate General in Porto Alegre: State of Rio Grande do Sul;

  • Italian Consulate General in Rio de Janeiro: States of Rio de Janeiro and Espírito Santo;

  • Italian Consulate in Belo Horizonte: State of Minas Gerais;

  • Italian Consulate in Recife: States of Pernambuco, Alagoas, Bahia, Ceará, Maranhão, Paraíba, Piauí, Rio Grande do Norte, and Sergipe;

  • Consular Office of the Italian Embassy in Brasília: Federal District, States of Amapá, Amazonas, Goiás, Pará, Roraima, Tocantins, and Suriname.

 

STEP 11 – ISSUE THE PASSPORT

After registration in the AIRE of the relevant Italian Consulate, the new Italian citizen may request the issuance of the passport.

It is not possible to request the passport issuance in Italy if your fiscal address is not there. The issuance of this document is linked to the applicant's place of residence.

That is, if you live in São Paulo – Brazil, you must request your passport at the São Paulo consulate!
